In a testimony to the Civil Police, he claimed that he and Kethlyn had been drinking alcohol on the night she was killed.

He claims Kethlyn asked if she could sit on his lap and drive his car.
He says he handled a gun, which he thought was not loaded, and fired it inside the vehicle accidentally.
A bullet struck Kethlyn in the head, and Tomiello rushed her to a hospital.
Local press reported that witnesses at the hospital said he was in a state of shock and begged for the teenager to be saved.
The medical team tried to save her for around 40 minutes to no avail.
Kethlyn died on Saturday (3 May), and Tomiello surrendered himself to police on Monday (5 May), as reported by Need To Know.

The teenager’s death is now being investigated by police.
Questions have also been raised about the couple’s alleged relationship.
Kethlyn turned 15 on 31 March this year and if it is proven that the pair began a sexual relationship before she turned 14, Tomiello may face charges for rape of a vulnerable person.

In Brazil, the age of consent for sexual activity is 14 years old.
Kethlyn was shot in Guarantã do Norte, a municipality located in Mato Grosso state, Brazil.
