Emergency responders confirmed Daniel, 18, had died at the scene.
The crash happened on the A-355 near Coín, between Málaga and Marbella, on the evening of 10 November.
The driver fled but later turned himself in at Coín police station, where he reportedly tested positive for cannabis.

The foreign national was arrested, and authorities are investigating the circumstances, including whether he held a driving licence valid in Spain.
The stretch of road has seen numerous accidents in recent years, according to local media.
Daniel was from nearby Monda but lived in Coín with his partner, as reported by Need To Know
He had played for several clubs in Málaga province, including CD Puerto Malagueño, UD Mortadelo, CD Athletic de Coín, and CD Cártama.
He was not attached to a club at the time of his death.

“We send all our love and support to his family, friends, and especially his cousin, Alin, a player in our Juvenile team in the Second Andaluza division.
“Rest in peace, Daniel. You will always be part of the Mortadelo family.”
