Police were called to the crash in Villavicencio, Colombia, and arrested Marlon Ricardo Sierra Zamora at the scene.
The 31-year-old is alleged to have stopped some distance beyond the point of impact.
He later tested over the alcohol limit, with a low but illegal level in his blood.
Ángel’s family claim there was a significant delay between the crash and the alcohol assessment.

The Llaneros FC midfielder has since been released pending further proceedings and has reportedly resumed training.
The Villavicencio-based club compete in the Categoría Primera A, Colombia’s top division.
Investigators are said to be examining whether Sierra lost control while speeding, as reported by Need To Know.
The crash came just hours after Llaneros’s 2-2 draw with Independiente Medellín in the Primera A.
At the time of writing, the club had not commented on the events or on any potential professional sanctions, should he be found guilty of causing injury by negligence and failing to render assistance.

Ángel, a father of seven, was said to be well liked and had spent more than 20 years working in security to support his large family.
Local reports variously give his age as 65 or 68.
Sierra previously played for Jaguares de Córdoba in Colombia’s top flight and for Celaya in Mexico.
The investigation is ongoing.
