A businessman believed to have murdered his ex-wife will only be tried for kidnapping because the police can’t find her body.

Ana Maria Henao Knezevich went missing from her flat on 2 February.

And while Spanish police have been searching for her, they still haven’t found any trace.

The 40-year-old Colombian-American had divorced her husband David Knezevich before moving to Madrid, Spain, to make a fresh start.

Knezevich’s lawyer is claiming his client has never even been to Spain, as reported by Need To Know.

But the police have released photos showing a man resembling Ana’s ex-husband, a Serbian national, purchasing duct tape and spray paint in Madrid.

The suspect was later filmed covering a CCTV camera in Ana’s block of flats ahead of her disappearance.

A car known to have been hired by Knezevich, 36, in Serbia was also caught on camera on the motorways around Madrid around that time.

He was arrested after landing at Miami International Airport, Florida, US, in May, and is currently being held in custody in a Florida prison.

The police believe Knezevich strangled his ex-wife in her flat before loading her body into his hire car’s boot.

As Spanish police haven’t found any trace of Ana in Spain, they believe he drove her body to his home in Serbia via France, Italy, Slovenia and Croatia.

Knezevich is protesting his innocence.

His trial for kidnapping will begin in Miami on 21 October.

If Ana’s remains are found, US prosecutors will likely charge him with murder.

According to reports, he could be charged with murder anyway, but prosecutors are likely waiting for a breakthrough as local law stipulates that he can’t be tried for the same crime twice.

If convicted of kidnapping, he faces up to life in prison.

If charged with and convicted of murder, he could face the death penalty.
